After years of testing, the FDA finally approved Celebrex for the treatment of osteoarthritis and rheumatoid arthritis in 2014. However, the company’s lawyers say it isn’t likely to appeal.
“I don’t see a substantial chance,” said Jim McElroy, president and chief executive officer of Pfizer.
The company’s lawyers also point out that Celebrex isn’t an “inhibitor” of the pain-relieving drug, Celebrex.
Celebrex was developed by scientists who studied the effects of the drug on pain and inflammation. Pfizer had been testing it in patients with osteoarthritis.
But in 2010, Pfizer’s lawyers said it was working on a “potentially stronger” product. The company’s lawyers say it’s not likely to appeal.
In April 2016, Pfizer filed an application to take action on a Celebrex “black box” warning. The FDA had not issued a black box warning.
In July of 2016, a federal judge in New York ordered the FDA to remove a black box warning. The judge dismissed the application.
As a result of the judge’s decision, Celebrex became the only prescription drug on the market that doctors can use to treat their arthritis.
“This was a huge mistake,” McElroy said.
The FDA’s decision to remove the black box warning, which can cause people to stop using the drug, is similar to the one Pfizer had faced with other pain-relieving drugs.
Some of the side effects of Celebrex include stomach pain, bloating, gas, upset stomach, diarrhea, and vomiting.
“This was an important safety concern,” said Michael Pearson, a spokesman for Pfizer, which makes Celebrex. “We had to withdraw the black box warning because of the side effects.”
Pearson and others say they didn’t take action immediately.
In April 2015, a federal judge in New York ordered Pfizer to pay a $1.6 million settlement over allegations that it improperly marketed Celebrex. The company is appealing the decision.
McElroy said Pfizer’s lawyers said they’re hopeful the case will get the FDA to take action. But they also point out that, even with the settlement, the company is still waiting for a ruling.
McElroy says there’s “not a lot we can do” about the FDA’s decision.
“We hope so,” he said. “I hope so because we’ve seen cases like this and we’re not sure how to proceed.”
The FDA’s decision is just the latest in a string of legal cases that are expected to be filed by pharmaceutical companies across the country.
